WWPNA Zoning Committee
Tuesday, May 26, 2009
The meeting convened at 7:05 p.m., and the Committee members present were Charlotte
Winzenburg (Chair), Gertie Grant, Gloria LeFree, Barry Sarver, David Callaghan, Terri Ficke,
and Fred Hammer. The minutes of April 28, 2009 were approved by the Committee members
present who attended the meeting. Guests present were; Sheila Robinson, Lisa Reynolds, and
Jon Hindlemann. A sign?in sheet with contact information is attached.
NEW BUSINESS
The first order of business was the Zoning Appeal Application (Case #63?09) for 994 South
Ogden Street. It is an appeal of a denial of a permit to erect a 2nd story addition 2 feet 2 inches
into the 5 foot north side setback in an R?1 zone. The possible remedy is a variance.
Lisa Reynolds, co?owner of the property with Chris Nevitt, described the existing single story
home, where it resides on the lot, and what their plans were for the 2nd story addition. The
‘architect of record,’ Jon Hindlemann gave the Committee a set of drawings that further
depicted the planned addition, and spoke about the circumstances requiring a variance. The
north setback roof violation is due to the fact that the north wall and a portion of the existing
roof are already within the side setback (having been constructed in 1916). None of the new
second story living space is within the front or side setbacks but the entire roof of the
existing home must be removed to facilitate construction of the new upper floor. When the
roof is reconstructed, there will be no bulk plane violations and the side form of the roof at
the area in question will resemble that which is existing with the exception of a portion of
the north eave which will no longer extend into the side setback as much as the existing eave.
The newly constructed north portion of the roof overhang will meet current fire separation
code requirements. Signatures of approval from owners/renters in six nearby homes were
shown to the Committee. The neighbor next door to the north was presented and expressed
some concern about loss of sunlight, but was generally in support of the addition.
It was noted that the present home has 1350 square feet of living space on the 1st level and a
three?quarters basement. Gertie reported that 66 leaflets were delivered to near?neighbors and
that there was no response in opposition. Since the hardship was not one created by the owner,
MOTION: Gertie Grant moved that the Zoning Committee recommend to the WWPNA
Board to send a letter of support for the variance at 994 South Odgen Street, based on the
reasons highlighted above. David Callaghan seconded. The motion carried. 7?0?0
UNFINISHED BUSINESS
769 South Corona Street – Appeal of a denial of a permit to erect a 2nd story addition to a single
unit dwelling 2 feet into the 5 foot north side setback and approximately 11 feet into the 27 foot
9 inch South Corona Street average front setback, in an R?1 zone. The variance was granted to
the plans submitted to the Board.
634 South Clarkson Street – Appeal of an order to discontinue maintaining a detached garage,
erected/altered without permits, encroaching 2 feet into the 5 foot rear setback, in an R?1 zone.
The variance was granted to allow the garage addition to remain as built, with condition that
this relief is personal to this structure and does not run with the land if the current garage is
demolished and rebuilt.
OTHER BUSINESS
Charlotte reported on the recent Zoning Code Task Force meeting that included the completion
of surveying in the northern part of WWP, which is mostly zoned R?3. Of note, the city maps
did not always reflect what was found on a block?by?block canvas. Several pockets of
predominately single family homes do exist.
Charlotte reminded everyone of the upcoming meetings: WWPNA Board meeting on June 2,
2009; Councilman Nevitt’s meeting to discuss the new zoning code on May 30th (Park Place, 10?
12); and, the next Zoning Committee meeting on June 30, 2009.
There being no further business, the meeting was adjourned at 8:05 p.m
